James Island is three jurisdictions on one island

This is the thing that trips up James Island homeowners, and even some contractors. A single neighborhood, sometimes a single street, can be split between the Town of James Island, the City of Charleston, and unincorporated Charleston County. The three have different permit rules, and "I live on James Island" doesn't tell you which one governs your fence. Establishing that is the first thing we do.

Town of James Island and Charleston County: light on paperwork

Both the Town and the County take the same permissive line for ordinary residential fences:

• No zoning permit is required for a fence under 6 feet, provided it's exempt from the building code, except for brick, stone or concrete fences, which do need review.
• The binding constraint is vision clearance at corners and driveways: your fence can't block sightlines. The Town keeps a sight triangle clear between roughly 30 inches and 10 feet above the ground; the County keeps it clear between 3 and 10 feet, with a 15-by-15-foot triangle at residential driveways.
• Neither sets a hard maximum height number in zoning for a standard lot, the 6-foot figure is the permit threshold, not a legal cap, so a taller fence is possible but changes the paperwork.

A practical note that matters here: James Island is cut through with marsh, tidal creeks and drainage easements, and a fence can't obstruct a drainage course. We read the plat before laying out a line near the marsh.

If your lot is in the City of Charleston

The city portions of James Island play by city rules, and those are stricter on process: a fence permit is required, and if the parcel sits in a Board of Architectural Review district or overlay, BAR review applies, with its firm limits on materials. Because the line between city and non-city parcels here is genuinely irregular, we confirm your parcel's jurisdiction before quoting a timeline, since it decides whether a permit is even needed.
